Turning Point USA Fires Back at ICE Shooting Lawyer Over Deleted Charlie Kirk Post

The conservative youth organization accuses the attorney of misrepresenting a deleted social media post by founder Charlie Kirk, defending free speech while the nation debates immigration enforcement tactics.

Turning Point USA (TPUSA) forcefully responded on Monday to criticism from a lawyer representing the family of a man fatally shot by U.S. Immigration and Customs Enforcement (ICE) agents during a raid in Phoenix, Arizona. The attorney, Samuel Rodriguez, had publicly demanded an apology from Charlie Kirk after the conservative commentator posted and then deleted a message that Rodriguez claimed celebrated the use of lethal force.

The controversy began last Thursday when Kirk shared a brief post on X that read, “ICE agents do what politicians won’t. Order maintained.” The post was deleted within hours, but not before screenshots circulated widely. Rodriguez, in a press conference on Friday, called the statement “reckless and dehumanizing” and accused Kirk of “cheering the death of a father of three.” The deceased, José Martínez, 34, was shot after reportedly lunging at an agent with a knife, according to preliminary police reports.

TPUSA fired back with a statement of its own, calling Rodriguez’s interpretation “a deliberate distortion.” “Charlie Kirk did not celebrate a death; he defended the lawful actions of federal officers who face daily threats,” the organization said. “The deleted post was a brief reaction to a complex situation, and any suggestion that TPUSA advocates for extrajudicial violence is a smear.” The group also released a side-by-side comparison of Kirk’s original post and the full incident report, arguing that the context justified the deletion as a matter of “prudence, not guilt.”

The lawyer, however, insists that the deletion itself is evidence of bad faith. “If Mr. Kirk truly believed his remarks were correct, he would not have removed them,” Rodriguez told reporters outside the Maricopa County courthouse. “Instead, he and his organization are trying to rewrite history.” The back-and-forth has reignited a larger national conversation about immigration enforcement, free speech, and the role of activist organizations in shaping public opinion.

Why this matters: The clash between TPUSA and Rodriguez is not merely a personal spat. It reflects a deepening divide over how the country addresses border security and internal enforcement. On one side, conservatives argue that ICE agents operate under immense pressure and deserve public support. On the other, civil liberties groups and many Latino advocacy organizations contend that the agency’s tactics too often result in unnecessary deaths, especially among nonviolent individuals. With the 2026 midterm elections approaching, both sides are using incidents like this to galvanize their bases.

FORTIS analysis: At its core, this dispute hinges on the interpretation of a single, quickly deleted post. While TPUSA’s defense of free speech is principled, the organization must also recognize that public figures are held to a higher standard of accountability. A post that can be read as endorsing lethal force, even inadvertently, invites legitimate criticism. At the same time, Rodriguez’s characterization of Kirk’s intent may be overstated. The factual record — including body camera footage that reportedly shows Martínez holding a knife — does not support the claim that Kirk “cheered” a death. Instead, it suggests Kirk was affirming the necessity of the officers’ actions.

Counterpoint: Rodriguez and the family of José Martínez argue that the knife was not brandished in a threatening manner and that the shooting was excessive. They point to past ICE settlements for wrongful death as evidence of systemic problems. While those cases are real, each incident must be judged on its own merits. In this instance, the available evidence — including an affidavit from a fellow officer — indicates that Martínez ignored multiple verbal commands and advanced toward the agent. That does not automatically justify the shooting, but it does complicate the narrative of a “reckless” killing.
